Delhi Budget Addresses Gig Economy — Dedicated Rest Spaces and Auto/Taxi Driver Welfare Board for Platform Workers
CM Rekha Gupta announced two key provisions for gig workers in the Delhi Budget 2026-27: dedicated rest spaces adjacent to or near Atal Canteens, and a Gig Worker Welfare Board structured as an Auto/Taxi Driver Welfare Board. The announcements come against the backdrop of a nationwide gig workers’ strike on Christmas and New Year’s Eve, and the central government’s request to platforms to drop the controversial “10-minute delivery” deadline.
Constitutional & Legal Framework
- Article 21: Right to life includes the right to dignified working conditions.
- Article 23: Prohibition of forced labour and traffic in human beings — relevant to exploitative gig conditions.
- Article 41 (DPSP): Right to work, education, and public assistance.
- Article 43 (DPSP): Living wage and decent standard of life for workers.
- Code on Social Security, 2020: The first Indian law to formally recognize gig workers and platform workers.
The Gig Worker Crisis
India has a massive and growing gig economy, with Delhi being a major hub. Workers travel for hours on vehicles with no resting spaces, leading to fatigue-related accidents and health issues. The CM acknowledged: “There is a huge population of gig workers in Delhi.” The nationwide strike by gig workers on Christmas and New Year’s Eve highlighted demands for adequate resting facilities, better pay, and an end to exploitative delivery deadlines.
Code on Social Security, 2020: A First Step
The Code on Social Security, 2020 was groundbreaking as the first legislation to define and recognize gig workers (those working outside traditional employer-employee relationships) and platform workers (those accessing work through online platforms). However, the rules for implementation remain pending, and actual social security benefits have been slow to materialize.
CLAT Exam Angle
The gig economy is an emerging area for CLAT. Questions may test knowledge of the Code on Social Security, 2020, the distinction between gig workers and platform workers, DPSP provisions on labour welfare (Art. 41, 43), and Article 23’s application to modern labour exploitation. Reading comprehension passages may explore the balance between technological innovation and worker rights.
