WTO Framework — Legal Basis for FTAs

Under international trade law, FTAs are permitted exceptions to the Most Favoured Nation (MFN) principle of the WTO. The key legal provisions governing FTAs include:

  • GATT Article XXIV: Permits regional trade agreements (RTAs) if they cover substantially all trade and do not raise barriers to non-members
  • GATS Article V: Permits services trade agreements (Economic Integration Agreements)
  • MFN Principle: WTO members must give equal trade treatment to all members — FTAs create exceptions
Constitutional Framework — India’s Treaty-Making Power
Article 253: Parliament can make laws for implementing international treaties (trade agreements)
Article 73: Executive power extends to matters on which Parliament can legislate
Entry 14, Union List: Treaties, agreements, conventions with foreign countries
India’s DPDPA 2023: Data Protection Act central to EU data adequacy negotiations

Key Contentious Issues in India-EU FTA Negotiations

Issue India’s Position EU’s Demand
Intellectual Property TRIPS-plus provisions resisted Stronger IP protection, data exclusivity
Data Localization DPDPA 2023 framework Data adequacy, free data flows
Tariffs Protect agriculture, auto sector Reduce tariffs on automobiles, wine, spirits
Carbon Border Tax (CBAM) Opposes as trade barrier Implements from 2026
Mnemonic — WTO Agreement Types:
GATT — Goods And Trade Treatise (merchandise trade)
GATS — General Agreement on Trade in Services
TRIPS — Trade-Related Intellectual Property Rights
DSU — Dispute Settlement Understanding
Remember: WTO = GATT + GATS + TRIPS + more

Geographical Indications and India-EU FTA

A key component of FTA negotiations is Geographical Indications (GI) protection. India’s GI Act 1999 protects products like Darjeeling Tea, Basmati Rice and Alphonso Mangoes. The EU wants stronger GI protections in the FTA, especially for European products like Champagne and Parmigiano-Reggiano in India.

Frequently Asked Questions

Why were India-EU FTA negotiations paused in 2013?

Negotiations paused due to disagreements on intellectual property (data exclusivity for pharma), government procurement, and liberalization of professional services. The 2022 re-launch reflects changed geopolitical priorities post-COVID and Russia-Ukraine war.

What is GATT Article XXIV significance for CLAT?

GATT Article XXIV is key for CLAT GK — it is the WTO provision that allows countries to form free trade agreements as exceptions to the MFN principle, provided they cover substantially all trade.

How does Carbon Border Adjustment Mechanism (CBAM) affect India?

EU’s CBAM imposes carbon price on imports from countries without equivalent carbon pricing. India’s steel, aluminum, cement and fertilizer exports to EU will face levies from 2026. India has challenged this at WTO as a non-tariff barrier.
