India’s Migration Governance Has a Blind Spot — Gulf Evacuation & OMF&W Bill (CLAT 2027)

When the Ministry of External Affairs evacuated 8.4 lakh Indians from West Asia by mid-April 2026, the consular machinery worked — but an Indian Express editorial argues it worked at a “moment of disruption” rather than across the worker’s journey. India had 99.35 lakh migrants in GCC countries as of December 2025, with 79 per cent of the USD 379 billion 2023-24 remittance pool flowing from the Gulf. The Overseas Mobility Facilitation & Welfare Bill, pending in Parliament, is being framed as the architectural shift from evacuation diplomacy to a continuous mobility architecture.

For CLAT 2027, expect passages on the Emigration Act 1983, the ECR (Emigration Check Required) category, bilateral labour agreements, the Vienna Convention on Consular Relations 1963, and right-to-livelihood jurisprudence under Article 21.

Constitutional & Legal Framework

Emigration Act 1983 is the parent statute, dividing passport holders into two classes: ECR (Emigration Check Required — applies to 18 notified countries) and Non-ECR. It regulates recruiting agents and requires emigration clearance from the Protector of Emigrants.

Article 19(1)(g) guarantees the right to practise any profession, occupation, trade or business — which extends to overseas employment opportunity, subject to reasonable restrictions under Article 19(6).

Article 21Olga Tellis v BMC (1985) established that the right to livelihood is an integral facet of the right to life. Denial of fair working conditions abroad implicates this guarantee.

Vienna Convention on Consular Relations 1963 codifies the duties of missions to their nationals abroad — notification of arrest, consular visits, communications. India ratified VCCR in 1977.

ILO Convention 181 (1997) on Private Employment Agencies covers recruitment agencies’ conduct and worker protection. India has not yet ratified C181.

Article 51 (DPSP) directs the State to promote international peace and respect international law; Article 253 empowers Parliament to legislate to implement treaties.

Why This Matters for CLAT 2027

Migration governance is an under-taught but high-yield CLAT topic because it binds four discrete legal areas. Key distinctions to memorise:

  • ECR does NOT mean “risky country” — it means a country where low-skilled Indian workers have historically faced exploitation. Currently 18 notified countries, mostly GCC + Southeast Asia.
  • Remittances ≠ FDI. Remittances are transfers by natural persons; FDI is by enterprises. India received USD 125+ billion in remittances in 2023-24, the largest globally.
  • Consular jurisdiction is territorial. Once a worker crosses the border, host-State labour law governs — which is why bilateral labour agreements (BLAs) matter.
  • Pravasi Bharatiya Divas is observed on 9 January each year — commemorating Gandhi’s return to India from South Africa on 9 January 1915.
