What is Section 17A?
Introduced through the 2018 Amendment to the Prevention of Corruption Act, 1988, Section 17A mandates that:
- Investigating agencies (CBI, police) must obtain prior approval from the government before initiating any enquiry or investigation against a public servant
- This approval is required only for acts done in discharge of official duties — not for personal misconduct
- The provision was designed to shield honest officers from frivolous and malicious complaints
Justice Viswanathan — Upheld Section 17A
• Described bureaucrats as the “Steel Frame” of India’s administration
• Recognised the “play it safe syndrome” — officers avoid bold decisions due to fear of investigation
• Argued prior approval acts as a reasonable filter against politically motivated complaints
• Held that Section 17A strikes a fair balance between accountability and efficiency
Justice Nagarathna — Struck Down Section 17A
• Found Section 17A violates Article 14 (Right to Equality) — creates unreasonable classification
• Warned of an “institutional nexus” where the executive controls investigation of its own officers
• Argued the provision effectively places bureaucrats above the law
• Emphasised anti-corruption mechanisms must not be weakened by procedural hurdles
Current Status — Referred to Larger Bench
Due to the split verdict, the matter has been referred to a larger bench for final determination. This is standard Supreme Court procedure when a two-judge bench is divided.
Viswanathan = V for Valid (upheld Section 17A, protects Steel Frame)
Nagarathna = N for Null (struck down, violates Article 14, institutional nexus)
